(Source: MIRS.news, Published 02/10/2026) U.S. Sen. Elissa Slotkin (D-Holly) said on Tuesday that President Donald Trump’s prosecutors failed to get a grand jury indictment against her for her role in a 90-second social media video reminding Armed Services members they should disobey illegal orders.
Slotkin said U.S. Attorney Jeanine Pirro sought the indictment at President Trump’s “direction.”

“Today, it was a grand jury of anonymous American citizens who upheld the rule of law and determined this case should not proceed,” Slotkin said in a late-night statement, “Hopefully, this ends this politicized investigation for good."
“But today wasn’t just an embarrassing day for the Administration. It was another sad day for our country,” she added, “Because whether or not Pirro succeeded is not the point. It's that President Trump continues to weaponize our justice system against his perceived enemies. It’s the kind of thing you see in a foreign country, not in the United States we know and love.”
The other Democrats who participated in the video were also not indicted.
In November, Trump accused Slotkin and the other Democratic veterans of engaging in “seditious behavior,” punishable by “DEATH” or jail time for the video.
The video featured Slotkin, a former CIA officer; U.S. Sen. Mark Kelly (D-Ariz., U.S. Navy Captain); U.S. Rep. Chris Deluzio (D-Penn., U.S. Navy); U.S. Rep. Maggie Goodlander (D-NH, former intelligence officer); U.S. Rep. Chrissy Houlahan (D-Penn., former Air Force) and U.S. Rep. Jason Crow (D-Colo., Army ranger, paratrooper) in which they say to members of the military and the intelligence community that, “You can refuse illegal orders.”
The New York Times first reported that the grand jury was meeting and citing anonymous sources, the newspaper reported that no indictment had been issued.
Slotkin’s statement didn’t say what charges Pirro sought, but The New York Times reported that it involved a law that “forbids interfering with the loyalty, morale or discipline of the U.S. armed forces.”
“No matter what President Trump and Pirro continue to do with this case, tonight we can score one for the Constitution, our freedom of speech and the rule of law,” Slotkin said.
