(Source: MIRS.news, Published 12/19/2023) Attorneys for four of the 16 Trump electors have asked the Kent County Circuit Court to dismiss a “patently frivolous” lawsuit filed by three Biden electors.
The American Freedom Law Center (AFLC), which represents four of the 16, argues the civil claims brought against the Trump electors – who also face felony charges in Ingham County – fail “as a matter of law” and are “patently frivolous.”
“Undoubtedly, the 2020 general election was contentious,” attorney Robert J. Muise wrote in the court filing. “But so are most general elections. For example, Al Gore repeatedly claimed that the 2000 election was ‘stolen’ by George W. Bush . . .
“Hillary Clinton continues to claim that the 2016 election was ‘stolen’ by Donald Trump,” the filing noted. “. . . It’s the nature of politics.”
Kent County Circuit Court Judge Christina Elmore will hear the matter via Zoom at 9 a.m. Jan. 5.
Plaintiffs – Blake Mazurek, of Kent County; Robin Smith, of Ingham County; and Timothy Smith, of Ottawa County – were nominated to serve as three of the 16 Democratic electors. They allege that they were the “true electors” of Michigan and that the defendants’ “fake elector scheme was illegal under Michigan law.”
They allege invasion of privacy, statutory conversion and civil conspiracy.
In his filing, Muise argues the plaintiffs want a judgment on a “pretended controversy” and is moot.
“… The goal of this motion is to put a stop to the weaponization of the legal process to attack political opponents,” Muise said. “Our republican form of government will not long sustain such an abusive use of the courts.”
Muise’s clients are asking the court to order the plaintiffs to pay their attorneys’ fees and costs.
